These terms cover your use of nordmeyercreative.com, the public website. Anything you buy from our shop is covered separately by our Terms of Sale, and work we do for clients is governed by a signed proposal. The section on client work below explains how that fits together, and it is the most important part of this page.
Using this site
You are welcome here. Read the pages, take anything we have offered for download, and get in touch. In return, please do not attempt to break into any part of the site, interfere with how it runs for other people, scrape it at a scale that degrades it, or use it to send us anything unlawful. We may restrict access if any of that happens.
Our content
The text, layout, photography, illustration, code, and design of this site belong to Nordmeyer Creative LLC, as do the Nordmeyer Creative name and mark. You are free to link to any page here, and to quote a short passage with attribution. Copying substantial portions, or reusing the design or the code, needs our written permission first.
Work shown in our portfolio
The case studies and project images on this site show work produced for clients. Those clients own their own brands, logos, product names, and content. That material appears here to illustrate what we did, and nothing here transfers any rights in it. If you are one of our clients and would rather a piece of work was not shown, tell us and we will take it down.
Accuracy of what you read here
We keep this site current and we work hard to get it right. Even so, prices, package contents, timelines, and descriptions change, and pages can fall out of date between updates. Nothing on this site is a formal offer or a guarantee of a particular result. Treat it as a good faith description and confirm the details with us before you rely on them.
Links and services from other companies
Some pages link out to other websites, and some features here are provided by outside services. We do not control those, and we are not responsible for their content or for how they handle your information. Their own terms apply while you are with them.
No warranty
This website is provided as it stands, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non infringement. We do not promise that the site will always be available, free of error, or free of anything harmful, though we would very much like it to be.
Limitation of liability
To the fullest extent the law allows, Nordmeyer Creative LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of your use of this website. Where liability cannot be excluded, our total liability relating to this website is limited to one hundred United States dollars.
This section is about the website. It does not limit anything agreed in a signed proposal, and it does not exclude any liability that cannot lawfully be excluded.
Website reports and scores
If you are a client, we may give you a private dashboard and monthly reports about your website. The scores in them are point-in-time measurements from public testing tools such as Google Lighthouse. They help us find and fix problems, but they are not a guarantee of security, accessibility, or search rankings.
Dashboard access and monthly reports continue while your plan, or an included access period, is active, and they end when that plan or period ends. What we have agreed to do for you is set out in your signed proposal, and that document controls if anything here seems to differ.
Client work is governed by your signed proposal
This page governs use of this website only. It does not set the terms of any engagement between Nordmeyer Creative LLC and a client.
Engagement terms, including scope, fees, payment schedule, term length, ownership, and any lease, Build Value, Buyout, or Renewal provisions, are set by the proposal you signed. That signed proposal is the contract. If anything on this website, whether on this page or any other, conflicts with your signed proposal, the signed proposal controls.
If you are not sure which document applies to your situation, ask us and we will point you to it.
Buying from the shop
Orders from our shop are not governed by this page. Ordering, pricing, production, delivery, returns, and refunds are all set out in our Terms of Sale, which applies to every order placed here. This page governs the website itself.
Governing law
These terms are governed by the laws of the State of Wisconsin, without regard to its conflict of law rules. Any dispute about this website will be brought in the state or federal courts located in Wisconsin, and you agree that those courts may hear it.
Changes to these terms
We may update this page. When we do, the date at the top changes. If you keep using the site after an update, the updated terms apply to you.
